Participation Agreement

You are an individual who desires to participate in events, classes, programs, and services sponsored or offered by Development Partners Golf Association, LLC (the “Company”) (collectively referred to herein as the “Activity”). In consideration of being permitted to participate in the Activity, you agree on behalf of yourself, your heirs, beneficiaries, executors, representatives, successors, and assigns as follows:You understand and acknowledge that the Activity involves serious risks and dangers including injury, pain, suffering, illness, disability, death, property loss, damage, harm, theft, or financial loss. You acknowledge that these risks may result from or be compounded by, in whole or in part, the actions, omissions, or negligence of yourself or others, including the Released Parties (defined below) and third-party venues. NOTWITHSTANDING SUCH RISKS, YOU ACKNOWLEDGE THAT YOU ARE VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH KNOWLEDGE OF THE DANGERS INVOLVED. YOU HEREBY EXPRESSLY AGREE TO FULLY ACCEPT AND ASSUME SUCH RISKS ARISING FROM YOUR VOLUNTARY PARTICIPATION IN THE ACTIVITY, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.You hereby expressly waive and release any and all claims, demands, actions, or causes of action, whether known or unknown, against the Company and its affiliates, and each of their respective officers, managers, members, employees, agents, representatives, contractors, insurers, successors, and assigns (collectively, the “Released Parties”) on account of injury, pain, suffering, illness, disability, death, loss, theft, damage, and harm arising out of or attributable to your participation in the Activity, whether arising out of the negligence of the Released Parties or otherwise. You covenant not to make or bring any such claim, demand, action, or cause of action against any Released Party and forever release and discharge the Released Parties from liability under such claims, demands, actions, or causes of action.You confirm that you are in good health and physically and mentally able to participate in the Activity. You acknowledge that it is solely your responsibility to consult with a physician prior to participating in the Activity. You will comply with all laws, orders, and guidelines related to the Activity and will follow all instructions, policies, rules, and cautions of the Company and any third-party venue. If at any time you believe conditions to be unsafe or that you are no longer in proper physical or mental condition to participate in the Activity, you will immediately discontinue further participation.You shall indemnify, defend, and hold harmless the Released Parties from and against any and all liabilities, claims, demands, actions, causes of action, losses, damages, judgments, settlements, awards, penalties, fines, fees, costs, or expenses of whatever kind arising out of or resulting from your participation in the Activity, including any claim related to your own negligence or the negligence of the Company.You grant Company permission to use photographs, videos, or other media taken while participating in the Activity for promotional and marketing purposes and will make no monetary or other claim against Company for use of such media.This agreement constitutes the sole and entire agreement with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings and agreements, both written and oral, with respect to such subject matter. If any term or provision of this agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision herein or invalidate or render unenforceable such term or provision in any other jurisdiction. All matters arising out of or relating to this agreement shall be governed by and construed in accordance with the laws of the State of Maryland, and any disputes must be brought only in the federal or state courts located in Maryland. This agreement will remain in effect and apply with equal force each time you participate in the Activity.YOU CERTIFY THAT YOU HAVE READ AND UNDERSTOOD ALL OF THE TERMS HEREIN AND THAT YOU ARE VOLUNTARILY GIVING UP LEGAL RIGHTS INCLUDING THE RIGHT TO SUE. YOU ARE AT LEAST 18 YEARS OF AGE, ARE FULLY COMPETENT TO AGREE TO THIS AGREEMENT, AND DO SO FREELY AND VOLUNTARILY.
